This Privacy Policy applies to BeThere and Thr Technologies Inc and governs data collection and usage. All references to the Company include be-there.ai and BeThere. BeThere helps you see when lives may align and turn that possibility into time actually spent together. By using the Company application, you consent to the data practices described in this statement.

California Consumer Privacy Act and California Privacy Rights Act

Contacts You Import

When you choose to import your device contacts, we receive the contact details you have stored for other people, including people who do not use BeThere. Depending on what you have saved, this can include a contact's name, phone number, email address, birthday, postal address, employer, and job title. We use this information only to help you find and connect with your people. We do not notify your contacts and we do not market to them. Contact information is protected under this policy, and if you believe your information was uploaded by another user and you would like it removed, contact us at hello@be-there.ai.

Location, Device, and Usage Information

With your permission, BeThere collects your device location so we can show you people and gatherings near you. You can turn location off at any time in your device settings. We also collect device identifiers, app usage information, and diagnostic data such as crash reports and performance data, which we use to keep the app working, understand how it is used, and fix problems. We use third party services for crash reporting, analytics, and install attribution. These providers process this information only on our behalf.

Phone Verification and Text Messages

We use your phone number to verify your account by text message and to deliver messages you ask us to send, such as invitations and introductions. Message and data rates may apply. You can stop text messages at any time by replying STOP.

We encourage you to review the privacy statements of websites you choose to link to from the Company so that you can understand how those websites collect, use, and share your information. The Company is not responsible for the privacy statements or other content on websites outside of the Company's website.

The Company collects and uses your personal information to operate and deliver the services you have requested. The Company may also use your personally identifiable information to inform you of other products or services available from the Company and its affiliates.

Use of your Personal Information

The Company collects and uses your personal information for the following purposes:

Right to Deletion

You can delete your BeThere account and associated data at any time from within the app under your profile settings. Subject to certain exceptions set out below, on receipt of a verifiable request from you, the Company will delete your personal information from its records and direct any service providers to delete your personal information from their records.

However, the Company may not be able to comply with your request of deletion if retaining the information is necessary for the Company or its service providers to: complete the transaction for which the personal information was collected; fulfill the terms of a written warranty or product recall; provide a good or service requested by you, or reasonably anticipated within the context of the Company's ongoing business relationship with you; detect security incidents; protect against malicious, deceptive, fraudulent, or illegal activity; debug to identify and repair errors; exercise free speech or ensure the right of another consumer to exercise their right of free speech; comply with the California Electronic Communications Privacy Act; engage in public or peer-reviewed scientific, historical, or statistical research in the public interest; enable solely internal uses that are reasonably aligned with your expectations based on your relationship with the Company; comply with an existing legal obligation; or otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

Children Under Thirteen

The Company does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this application.

Disconnecting your Account from Third Party Websites

You will be able to connect your Company account to third party accounts. BY CONNECTING YOUR COMPANY ACCOUNT TO YOUR THIRD PARTY ACCOUNT, YOU ACKNOWLEDGE AND AGREE THAT YOU ARE CONSENTING TO THE CONTINUOUS RELEASE OF INFORMATION ABOUT YOU TO OTHERS (IN ACCORDANCE WITH YOUR PRIVACY SETTINGS ON THOSE THIRD PARTY SITES). IF YOU DO NOT WANT INFORMATION ABOUT YOU TO BE SHARED IN THIS MANNER, DO NOT USE THIS FEATURE.

You may disconnect your account from a third party account at any time. Users may disconnect by visiting their account settings or by contacting us.

Opt Out and Unsubscribe

We respect your privacy and give you an opportunity to opt out of receiving announcements of certain information. Users may opt out of receiving any or all communications from the Company by visiting https://be-there.ai or contacting us at hello@be-there.ai.

Email Communications

From time to time, the Company may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our services, we may receive a notification when you open an email from the Company or click on a link therein.

If you would like to stop receiving marketing or promotional communications via email from the Company, you may opt out of such communications by replying STOP or contacting us.

Changes to This Statement

The Company reserves the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our application, and/or by updating any privacy information. Your continued use of the application and/or services available after such modifications will constitute your acknowledgement of the modified Privacy Policy and agreement to abide and be bound by that policy.
